YOUR FELLOW
WORKERS NEED YOUR HELP. In December 2006, a class action lawsuit was filed in Orange County Superior Court against
Bimbo Bakeries USA, Inc. on behalf of its California delivery drivers and sales route representatives. The lawsuit
seeks unpaid overtime compensation for hours work in excess of 40 per week, for which premium pay is not given at one and
one-half times the employee's regular rate of pay.The lawsuit seeks unpaid wages and other damages resulting from
the company's refusal to permit its hard-working drivers to take uninterrupted half-hour lunch breaks and regular paid ten
minute breaks during shifts of 3 1/2 hours or more. California law requires employers to pay overtime rates for all
hours worked over 8 in a workday or 40 in a workweek, even where a collective bargaining agreement does not call for such
pay.California law provides that employees who are not permitted to take the meal and rest periods allowed under
Industrial Welfare Commission Wage Order No. 5 must be paid one additional hour of pay for each day that the rest periods
are not permitted, and one additional hour of pay for each day that the thirty minute meal periods are not taken. We
believe that the failure to permit employees to take paid uninterrupted ten minute breaks, during which the worker is relieved
of all job duties, is a serious violation of California's workplace safety and wage and hour laws. We intend to put
an end to these serious violations of California law and are seeking back wages and penalties due under the California Labor
Code. We are also seeking punitive damages on your behalf. If the class action is successful, every Bimbo Bakeries
delivery driver and sales route representative in California may be entitled to compensation. Please contact our
